One of the most common questions from our foreign clients today is how to extend their work visa (Visa D) in Ukraine or renew their temporary or permanent residence permit.
According to Resolution of the Cabinet of Ministers of Ukraine No. 1202 dated October 21, 2022:
Residence permits (except those issued to citizens of the Russian Federation) whose validity has expired or which are subject to exchange according to the law after February 24, 2022, confirm the legal grounds for temporary or permanent residence in Ukraine and the right to enter Ukraine during the period of martial law and within 30 calendar days from the date of its termination or cancellation.
Foreigners or stateless persons (except citizens of the Russian Federation) are required, following the legislation, to submit documents for the exchange of such residence permits for temporary or permanent residence within 30 calendar days from the date of termination or cancellation of martial law.
Regarding work permits:
On September 21, 2022, changes were made to the Law of Ukraine’s “On Employment of the Population“, namely:
- Equal rights regarding wages for foreigners and Ukrainian citizens were established. The provision requiring foreigners to be paid from 5 to 50 minimum wages (the minimum wage on the day of writing this article is 6,700 UAH) for the same work offered to Ukrainian citizens has been removed. Thus, it is possible to pay the minimum wage per month.
- Foreigners can work in several positions or in specific companies, provided they obtain a permit for each position and each enterprise. However, they can work concurrently for the same employer without a permit, as long as the concurrent work does not exceed the validity period of the primary employment permit.
- Foreign students who are studying or have completed their studies must obtain a work permit (provided employment is obtained no later than 30 calendar days before the end of their studies). The key is issued free of charge but for a maximum duration of 1 (one) year.
The duration of the permit is not more than 2 (two) years.
